Terms of Service

These Terms of Service apply to all purchases and use of services from Tees & Overs, operating under German law. By accessing or using our website, you agree to be bound by these terms. Please read them carefully before placing an order.

1. Contractual Partner

Your contract is concluded with:

Tees & Overs
Raul Labo
Steinleiten 3
85302 Gerolsbach
Bayern, Germany
Email: teesandovers@yahoo.com

2. Applicability

These Terms apply to all purchases made through our online store and are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

3. Order Process & Contract Formation

The product listings in our online shop are not legally binding offers but non-binding invitations to order. A binding contract is only concluded when you receive an order confirmation from us via email or when the goods are shipped.

4. Prices and Payment

All prices include applicable VAT in accordance with German tax law. We accept payment via major credit cards, PayPal, or other available methods shown at checkout. Orders are only processed after successful payment.

5. Shipping and Delivery

We ship worldwide from Germany. Delivery times and shipping costs are displayed during the checkout process. You are responsible for any customs duties or import taxes for deliveries outside the EU.

6. Right of Withdrawal (Widerrufsrecht)

Consumers in the EU have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you (not the carrier) has taken possession of the goods.

To exercise your right of withdrawal, you must inform us via email at teesandovers@yahoo.com with a clear statement. Further details are provided in our Refund Policy.

7. Retention of Title

Goods remain our property until full payment has been made.

8. Liability

We are liable for intent and gross negligence. For simple negligence, we are only liable for damages from injury to life, body, or health, or for breach of essential contractual obligations. In the latter case, liability is limited to foreseeable, typical damages.

9. Data Protection

We collect and process your personal data only in accordance with applicable German and EU data protection laws (notably the GDPR). Please refer to our Privacy Policy for more information.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is our registered business location.

11. Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR), which can be accessed here: https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. Final Provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
